In an action to declare an agreement, purporting on its face to be a contract for the sale of stock by plaintiffs to defendant Weiss with an option on the part of the plaintiffs to repurchase at an increased price, to be actually a subterfuge for a usurious loan and void, the defendants Weiss and 39 Casino Street Corporation appeal from a judgment of the Supreme Court, Nassau County, entered November 2, 1960, upon the decision of the court, in favor of plaintiffs, after a non-jury trial. Disposition Judgment affirmed, without costs ( Fiedler v. Darrin , 50 N. Y. 437; Stockwell v. Richardson , 101 N. Y. 643, opinions reported in 5 N. E. 45; Todd v. Brown , 177 App. Div. 397).
